Masaryka 463, 738 01 Frýdek Místek, ID number: 25838377, VAT number: CZ258383, registered in OR managed by KOS in Ostrava, in section B, insert 2154, (hereinafter referred to as the "seller").b) Customer: - as a natural or legal person (hereinafter referred to as the "customer"). The subject of these General Terms and Conditions of INVA Groupa.s. - the Hotel Afrika establishment (hereinafter referred to as "GTC"), is the regulation of the terms and conditions of the implementation of accommodation and related services at Hotel Afrika, the GTC are an integral part of all arrangements, unless business relations are regulated by a contract in which it is stated otherwise. By confirming the Seller's Offer, or Orders of the Customer/Client (hereinafter referred to as the "Offer") - the Customer/Client recognizes the following General Terms and Conditions as binding for all performance related to the subject of General Terms and Conditions. 1. Prices and services Approximate prices for accommodation and any other services are listed in the Seller's presentation materials (websites, brochures, etc.). However, the price stated in the Accommodation Voucher (hereinafter referred to as the Voucher), which is sent to the customer by e-mail, is binding on the customer. For the scope of contractually agreed services and prices, their breakdown in the Voucher is binding. The Seller is entitled, in cases beyond his control (e.g. force majeure), to change the agreed conditions of the stay, or to cancel the stay without compensation and any financial compensation to the Customer. 2. Cancellation of the stay by the Customer (Customer).The customer is entitled to cancel the order at any time before arrival. Cancellation of the stay requires a written electronic form (email with delivery receipt) to adressurecepce@hotelafrika.cz. The date and time of sending the email are decisive for determining the time of cancellation of the stay. The Seller will not charge the Customer the cancellation fees indicated on the Voucher if he could not use the agreed services for the following reasons: death in the family, hospitalization of the customer or a member of his family, serious illness, recall order, natural disaster. The customer is obliged to document the above facts with a written document to the accommodation provider no later than 3 days after their occurrence. 3. Validity These business and cancellation conditions are an integral part of the accommodation order and accommodation voucher (voucher). For group stays, other reservation conditions can be negotiated. 4. Payment conditions The Customer is obliged to pay the price for the services provided by the Seller, which are specified in the confirmed Offer, including those that were additionally ordered. Payment is considered to have been made only when it is credited to the Seller's account, which is indicated on the tax document (invoice). Upon agreement with the Seller, the Customer has the option to pay for the services provided in cash or by credit card. If the Customer is in arrears with payment for the services provided, the Seller has the right to demand from the Customer, in addition to payment of the owed amount, a contractual penalty of 0.1% of the owed amount for each day of delay starting from the first day following the due date of the tax document (invoice) until its payment. All payments will be made in the currency that corresponds to the currency specified in the confirmed Offer. 5. Complaints The Customer is obliged to make a complaint about the services provided by the Seller to the person who, according to the confirmed Offer, arranges his order, immediately ascertaining the deficiencies at the place of their provision, i.e. at the Seller's premises, or in written (electronic) form no later than the day after the end of the accommodation. Later complaints will not be taken into account. 6. Other arrangements If the Seller, with all his efforts, is unable to meet the agreed conditions due to force majeure, he has the right to cancel the order without further ado, or and change accordingly. Force majeure means in particular war, mobilization, civil unrest, confiscation, strike, lockout, damage to the hotel and its facilities as a result of natural disasters or civil unrest, export and import restrictions, explosions, epidemics, material shortages caused by the above-mentioned reasons; in the event of force majeure, the Customer is not entitled to apply any sanctions or equivalent claims against the Seller.
